Terms of Service

This website is operated by Beyond Perfection Inc., a Canadian federal corporation, carrying on business as Mom & Zoey, a business name registered in Ontario ("we", "us", "our"). By accessing or purchasing from this website, you agree to these Terms of Service.

Eligibility

You must be the age of majority in your province, territory or state, and legally capable of entering into a binding contract, to place an order.

Products

We make every effort to display our products and their colours accurately. Screen rendering varies, and slight variation in colour, embroidery and hand-finished detail is a characteristic of the natural fabrics we use, not a defect.

All products are subject to availability. We reserve the right to limit quantities and to discontinue any product at any time.

Pricing and Currency

All prices are listed and charged in Canadian dollars (CAD). Prices are subject to change without notice. Applicable GST/HST/PST is calculated and displayed at checkout.

If you are ordering from outside Canada, your card issuer converts the amount to your local currency at its own exchange rate and may apply a foreign transaction fee. Those fees are charged by your bank, not by us.

We reserve the right to correct pricing errors and to cancel any order placed at an incorrect price, with a full refund.

Payments

Payments are processed securely through Shopify Payments and other trusted third-party providers. We accept major credit and debit cards (Visa, Mastercard, American Express), Apple Pay, Google Pay, Shop Pay and PayPal.

We do not store your card details. Payment card information is handled by our payment processor, which is PCI DSS Level 1 certified.

Shipping and Delivery

Orders ship from Brampton, Ontario. Delivery estimates are estimates, not guarantees. Orders shipped to the United States may be subject to import duties or fees assessed by U.S. authorities, which are the responsibility of the recipient. See our Shipping Policy.

Returns and Refunds

Returns are accepted within 30 days of delivery on unworn, unwashed items with tags attached. Full details, including who pays return shipping, are set out in our Refund Policy, which forms part of these Terms.

Intellectual Property

All content on this website — including designs, photographs, text, graphics and the Mom & Zoey name and logo — is the property of Beyond Perfection Inc. and is protected by Canadian and international intellectual property law. You may not reproduce or use it commercially without our written permission.

Limitation of Liability

To the fullest extent permitted by law, our total liability arising out of any order is limited to the amount you paid for that order. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Canadian consumer protection law.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Any dispute arising out of or relating to this website or a purchase made through it is subject to the exclusive jurisdiction of the courts of the Province of Ontario.

Changes to These Terms

We may update these Terms at any time. The version posted on this page at the time you place your order is the version that applies to that order.
